Dua Associates acted on behalf of The Dow Chemical Company and Union Carbide Corporation in a high stakes and complex litigation before the Supreme Court of India. A five-judge constitutional bench reserved its verdict on Union of India’s curative petition for enhanced compensation to victims of the industrial disaster that occurred in Bhopal in 1984 after a 3-day hearing in January 2023.
And on March 14 2023, Dua Associates led by Senior Solicitor Ms Shiraz Patodia, won the high profile, high stakes and extremely complex litigation before the Supreme Court of India.
The Apex Court’s decision in the matter is a landmark one as it covered within its ambit all aspects that relate to the scope and maintainability of a ‘curative petition’ in the current legal regime in India. It is also of great importance as the Supreme Court has opined on the civil liability of a successor corporation and vicarious liability of a corporation in a mass (environmental) tort action as well as question amenability to jurisdiction over a foreign corporation.The matter was worth over INR 7413 crores
