Firm overview

Wiggin and Dana is a full-service law firm of highly talented, creative and experienced lawyers dedicated to exceeding our clients’ expectations every day. With offices in Connecticut, New York, Philadelphia, Washington, DC, and Palm Beach, we represent clients throughout the United States and globally on a wide range of sophisticated and complex matters. From defending a Fortune 500 institution in “bet-the-company” litigation, to helping the next generation of inventors bring a new technology to market, to preserving the wealth that a family business has worked so hard to create, we pride ourselves in offering value driven solutions and results.

Litigation Overview: As a nationally recognized litigation law firm, Wiggin and Dana prides itself on the talent, drive, and integrity of its litigators. The firm’s deep bench includes leaders of the bar who have been honored with a fellowship in the American College of Trial Lawyers, the American College of Appellate Lawyers, membership in the Product Liability Advisory Council and recognized in Chambers USA, Benchmark Litigation, as well as in The Best Lawyers in America, Guide to the World’s Leading Litigation Lawyers, and The International Who’s Who of Commercial Litigation Lawyers. Most recently, Benchmark Litigation selected our department as the 2023 Connecticut Litigation Department of the Year, and our appellate and white-collar practices have recently been recognized as stand-out practices in Connecticut.

We work collaboratively with our clients to provide efficient and cost-effective legal services and encourage mutually beneficial alternative fee arrangements where feasible. And we keep our litigation teams lean and responsive. We know from experience that a limited number of knowledgeable and responsible people produces the best results, while keeping costs contained. How do we do this? It’s simple, we invest time in our clients and associates. We make it our business to know your business through our cross-disciplinary industry or client-specific practice teams. And we train our associates: for example, we have an annual nuts and bolts trial training program, an annual mock jury trial, and a writing program comprised of seminars and one-on-one instruction.

Our lawyers give the same dedication to pro bono clients as to the major institutions on our client roster. For example, in the past two years, Wiggin and Dana litigators prevailed at trial in a Section 1983 civil rights action, and settled another Section 1983 action on the eve of trial. In a Criminal Justice Act case we achieved two successive appellate victories in the Second Circuit on behalf of a prisoner convicted of Espionage Act violations. In 2014 alone the department represented 49 clients on a pro bono basis, and received awards from Connecticut Legal Services and New Haven Legal Assistance, the two largest legal aid organizations in Connecticut.

Wiggin and Dana recruits and cultivates talented associates, who come from highly ranked law schools, clerkships (our litigators have had over 30 clerkships), and from top national and international law firms. Our litigators have had distinguished careers as federal prosecutors, and collectively have well over 100 years of law enforcement and government experience. We encourage you to review the profiles of our litigation attorneys on our website.

Dispute Resolution
Known for handling market-shaping disputes and high-stakes litigation, the team continues to drive some of Wiggin and Dana's most significant representations. The firm's recent work includes representing OpenX in its antitrust action against Google, Leslie Berland in her severance dispute against X Corp. and Elon Musk, William Raveis in nationwide real estate commission litigation, and Epic Games in landmark antitrust battles against Google and Apple. These matters reflect the firm's strength in complex commercial, antitrust, and appellate litigation, as well as its ability to handle disputes with national significance.

Clients repeatedly point to the firm's effectiveness in both written advocacy and courtroom performance. When asked what the firm does well, one source remarked: "Win! They produce excellent briefs and other work product that cuts to the key issues and addresses them succinctly and effectively. They do just as well in the court room on their feet." Another client noted: "The firm does excellent work across the board, providing high-quality, strategic guidance that consistently aligns with the Company’s objectives." Nathan Denning has played an important role in a number of the firm's most prominent public matters. His recent work includes leading the representation of Leslie Berland in her high-profile severance dispute against X Corp. and Elon Musk, serving as co-lead counsel for OpenX in its antitrust litigation against Google, representing Peter Dooney in a successful property rights dispute, and holding key roles in the Generic Pharmaceuticals Pricing Antitrust Litigation, the American Express Anti-Steering Rules Antitrust Litigation, and Epic Games' antitrust litigation against Google and Apple. Clients are effusive in their praise, with one source stating: "Nathan excels at lead counsel in everything from case analysis to brief writing to oral argument. He rolls up his sleeves and learns the case inside and out and then reduces complex issues to short, understandable positions. Having practiced in big law for 25, I find his writing and argument exceptionally effective -- and the results so far confirm this."

Benjamin Diessel is another key figure in the firm's litigation and antitrust practice. His recent matters include co-leading OpenX's litigation against Google, representing William Raveis in nationwide antitrust litigation, serving as lead counsel for Aurobindo Pharma USA in the Generic Pharmaceuticals Pricing Antitrust Litigation, representing American Express in mass merchant arbitrations, participating in the Epic Games litigation against Google and Apple, and representing members of the Murdoch family in the highly publicized Murdoch Family Trust dispute. He also worked on the Yale New Haven Health System litigation arising from the Prospect Medical Holdings transaction. Sources emphasize both his legal acumen and practical approach. One client observed: "Ben masters the facts and case law and quickly ascertains what is really important. His honing in on the key facts and issues has allowed us to get a handle on a very large case with innumerable facts. He works very well with client personnel and as part of a team." Another added: "I have no hesitation referring a client to Ben on an antitrust (litigation or counselling) or IP matter. I know he will be responsive, provide thoughtful and practical advice, and implement a strategy geared towards getting the best result for the client."

John Doroghazi continues to build a strong reputation through his work on significant commercial and regulatory disputes. His public matters include representing William Raveis Real Estate in nationwide antitrust litigation concerning broker commission practices and representing Pike Fuels Limited Partnership in environmental litigation involving Clean Water Act claims and climate change-related permitting theories. Clients consistently praise his responsiveness and business-focused approach. One source commented: "I cannot speak highly enough of John Doroghazi. John consistently demonstrates exceptional legal skill, judgment, and franchise expertise. His responsiveness is outstanding, and he is always focused on advancing the Company’s best interests. John goes above and beyond to protect the Company’s interests and delivers meaningful, results-oriented outcomes." Paul Tuchmann has contributed to several notable antitrust matters, including the firm's representation of American Express in thousands of merchant arbitrations and its work for Epic Games in the landmark antitrust litigation against Google and Apple. Clients describe him as a highly capable practitioner, with one source noting: "Paul handled and oversaw an associate on a complex franchise dispute arbitration and obtained the Company's desire result. Paul is highly skilled."

Clients also recognize Dimitrios Tournas for his commercial real estate capabilities, with one source stating: "Dimitri handles complex lease issues and is highly skilled, and extremely responsive." As well as Kozikowski, stating "Colleen does a great job managing all aspects of the case. She excels at legal research, analysis, and writing."
