Employment Litigation: Our employment litigation experience runs the gamut from “bet the company” cases such as class actions or crippling strikes, to Fair Labor Standards Act (FLSA) challenges involving compensation or management practices, to Equal Employment Opportunity Commission (EEOC) cases. Our team regularly handles jury trials, bench trials, appeals, arbitrations and mediations nationally and internationally, at the federal, state and local levels, both in court and before administrative agencies, such as the Department of Justice (DOJ), Equal Employment Opportunity Commission (EEOC), Office of Federal Contract Compliance Programs (OFCCP) and National Labor Relations Board (NLRB), as well as in alternative dispute resolution forums, such as the American Arbitration Association (AAA) and JAMS. We defend claims of employment, disability and housing discrimination, wage and hour violations, breach of contract, harassment, retaliation and whistle-blowing and defend employers in class and collective actions, including wage and hour FLSA claims and discrimination class actions by employees (and customers). In addition we prosecute and defend claims relating to non-compete agreements, non-solicitation agreements and employee raiding and litigate complex labor-management matters.
Environmental Civil Litigation: Saul Ewing’s Environmental Civil Litigation attorneys represent clients in a broad range of civil and criminal litigation and administrative actions. Our litigators handle a range of environmental matters, including enforcement proceedings under Superfund, RCRA, the Clean Water Act, and other federal and state environmental statutes and environmental contract disputes. When clients face the costs of remediating contaminated sites, Saul Ewing’s Environmental Civil Litigation attorneys bring to the table their technical knowledge and skills (hydrogeology, engineering) plus litigation and trial experience to protect clients’ interests. Our attorneys have the breadth and depth of experience and skill necessary to defend a client charged with violating state or federal environmental statutes, including state solid waste management and clean water laws, as well as Pennsylvania mining and blasting statutes. Our team includes a former litigation counsel to the Pennsylvania Department of Environmental Protection and former state and federal prosecutors who now defend our clients in environmental matters.
Higher Education Litigation: The legal issues facing colleges and universities are more challenging than ever, reaching every corner of campus life with increasing complexity. From discipline to drones, Title IX to taxes, FERPA to financing, Saul Ewing has a deep bench of lawyers who wrestle with these issues every day, including acting as general counsel to small colleges and universities without in-house lawyers. In the past few years, our Higher Education Practice has rendered service in some of the nation’s highest profile matters, including multi-campus university systems in large-scale government investigations and in proactive compliance reviews and audits (Clery Act, Title IX, Title IV, Title II, minors on campus) and defending institutions in front-page news lawsuits, including allegations of hazing, child abuse, sexual violence, student death, suicide, faculty dismissal, racial discrimination, ADA discrimination, and more.
Insurance Litigation & Arbitration: The Insurance Practice represents insurance industry clients in litigation in the United States and abroad. We litigate in many forums – including private arbitration and in federal and state courts – and in various substantive areas, including coverage for environmental, asbestos and other mass tort liabilities, coverage under professional liability, E&O, D&O, fiduciary claims and other insuring provisions, and claims and matters relating to life insurance and long term care insurance. Our insurance litigators have also represented a number of large, national insurers in putative class action suits challenging a variety of different business practices in the sale of insurance policies, billing and collection practices, claims administration and payment practices and policy administration practices.
Intellectual Property Litigation: Our attorneys handle a variety of IP litigation cases across a wide spectrum of industries. We represent clients in federal courts throughout the United States, with significant bench and jury trial experience. We also handle matters before appellate courts, the Patent Trial and Appeal Board (PTAB) and the Trademark Trial and Appeal Board (TTAB). Our IP attorneys are also experienced in appearing before other alternative dispute resolution forums. In addition, we advise clients on ICANN domain name disputes before the National Arbitration Forum (NAF) and World Intellectual Property Organization (WIPO). Our IP litigators advise on a variety of cases, including patent infringement & litigation, copyright infringement & litigation, trademark infringement & litigation, trade secrets litigation and Hatch-Waxman Act/ANDA Litigation.

As former federal prosecutors and regulators our attorneys have direct, practical experience to help our clients enhance their compliance procedures and to rigorously defend them against government investigations.
