Focusing her practice on every stage of insurance recovery cases, Cindy Jordano represents a wide range of organizations in state and federal venues, as well as in arbitration. Cindy’s practice spans the country, while maintaining a New York emphasis. Cindy has advised on multiple disputes at the cutting-edge of insurance law, including significant wins in the D&O coverage space.
Throughout her career, Cindy has had several trial and arbitration wins, including an arbitration award that exceeded her client’s policy limit.
Recently, Cindy represented Alexion Pharmaceuticals, Inc. in securing a favorable summary judgment ruling finding that a securities action commenced against Alexion and its officers and directors was properly covered under a 2015-2017 tower of directors and officers’ liability insurance. The court ruled that the securities action was not excluded by the policies’ “Prior Notice Exclusion” because it was not sufficiently related to an earlier subpoena Alexion received from the SEC that it noticed under an earlier policy period.
As counsel to Clover Health Investments Corp., Cindy secured coverage in a case of first impression stemming from merger-related SPAC litigation. The court granted Clover Health’s motion for partial summary judgment and found that Delaware’s “larger settlement rule” applies to defense costs.
Cindy also represented Conduent Inc. in obtaining a rare reversal of a jury verdict due to the insurer’s counsel’s violation of evidentiary rulings, which confused the jury and resulted in a verdict that was manifestly unjust. In addition, the firm secured tens of millions of dollars in coverage for Conduent’s defense and settlement of a Medicaid investigation and related civil lawsuits by the Texas Attorney General.
Previously, Cindy clerked in the United States District Court for the Southern District of New York and practiced law at a leading New York litigation firm, where she handled a broad spectrum of cases, including antitrust, bankruptcy litigation, and shareholder disputes.
Following the launch of Cohen Ziffer in early 2021, Cindy became the firm’s first attorney elevated from associate to partner in November 2021. Cindy has been recognized as a Woman Worth Watching by Profiles in Diversity Journal.
