Oleg Elkhunovich, a partner in Susman Godfrey’s Los Angeles office, has a broad practice in high-stakes commercial litigation, representing both plaintiffs and defendants in a variety of legal practice areas including intellectual property, antitrust, securities, and class actions. With a strong background in Computer Science and Engineering, Elkhunovich often litigates cases involving complex technology issues, including in the areas of patents, trade secrets, consumer protection, and cryptocurrency.
Elkhunovich is a trusted trial lawyer with significant courtroom experience. He has tried four cases at the International Trade Commission. Most recently, Elkhunovich first-chaired an ITC trial on behalf of his client Vicor Corporation, a Massachusetts-based manufacturer of power modules, resulting in an Initial Determination in favor of Vicor. Elkhunovich also recently co-led a trial team in an arbitration hearing before JAMS to obtain an arbitration award in favor of his client Aspect Pharmaceuticals, LLC on claims of breach of a “commercially reasonable efforts” contract provision against a Big Pharma company.
Elkhunovich is a recognized leader in the field of cryptocurrency litigation. He currently serves as co-lead class counsel representing retail investors in two separate cases alleging that sales of certain cryptocurrency tokens constituted unlawful offerings of unregistered securities. The National Law Journal has named Elkhunovich among the Plaintiff Lawyer Trailblazers in 2020 for his work. Elkhunovich is sought out by the media to comment on cryptocurrency legal issues and has been invited to lecture on Securities Regulation at University of California Berkeley Blockchain for Lawyers class.
Elkhunovich has been recognized as one of the Top 500 Plaintiff Financial Lawyers by Lawdragon and Future Star by Benchmark Litigation. Elkhunovich was previously nominated for Public Justice’s Trial Lawyer of the Year Award for his work on behalf of the economic loss class action plaintiffs in multi-district litigation against Toyota, which culminated in a $1.6 billion settlement benefiting approximately 22 million class members—the largest settlement involving defective automobiles at that time.
In addition to trial work, Elkhunovich has also handled a number of appeals in both federal and state courts, and argued before the California Court of Appeals.
Elkhunovich is an active member of several bar groups and associations, including the Judge Paul R. Michel Intellectual Property American Inn of Court, for which he has served as team captain in three terms. Elkhunovich also has served on the Planning Committee for the USC Intellectual Property Institute.
Elkhunovich earned a Bachelor of Science in Computer Science and Economics and a Masters of Science in Computer Science degrees from Yale University, and graduated cum laude from the University of Pennsylvania Law School. Before joining Susman Godfrey, Elkhunovich clerked for then-Chief Judge Anthony J. Scirica on the United States Court of Appeals for the Third Circuit
