Qimin Zhu

Ms. Zhu has expertise in China’s commercial legal system and judicial practice, and specializes in handling commercial disputes.  With extensive experience at the Supreme People’s Court, local courts at all levels, China International Economic and Trade Arbitration Commission (CIETAC) and other institutions, Ms. Zhu has successfully recovered a substantial amount of losses for clients and gained deep trust of the clients.

• A well-known Chinese beverage company. Ms. Zhu participated in handling the disputes over control right between a well-known Chinese beverage joint venture and a foreign party, involving a total amount of over RMB50 billion and triggering dozens of cases. Among that line of cases, a dispute over confirmation of shareholder status where Ms. Zhu acted as an attorney is the very first case heard by the Second International Commercial Court of the Supreme People’s Court of the PRC (newly established under the “Belt and Road Initiative”) since its establishment, which attracted extensive media coverage;
• Mr. Zhan Ketuan. Ms. Zhu participated in handling a legal battle for control over Beijing Bitmain Technologies Co., Ltd. (Beijing Bitmain) between Mr. Wu Jihan and Mr. Zhan Ketuan. Due to Beijing Bitmain’s prominent position in the Bitcoin market, the battle has attracted wide media attention and coverage. The dispute was eventually settled smoothly trough the efforts of Ms. Zhu and her team;
• A large SOE in China. Ms. Zhu represented a large Chinese SOE in a factoring dispute with a financial leasing company in an arbitration proceeding before CIETAC. The case that is rather complicated and involves hundreds of millions of RMB is now ongoing;
• An A-share listed company in China. Ms. Zhu represented an A-share listed company in China in handling dozens of disputes over guarantee contracts caused by external guarantee provided by the listed company. The courts hearing such cases include the SPC of the PRC and local courts at all levels. The amount involved in these cases is billions of RMB. Most of these cases have achieved results to the clients’ satisfaction, some cases are still ongoing.
• A well-known securities company. Ms. Zhu represented the securities company before an intermediate people's court in a series of disputes on misrepresentation relating to a company's bonds, the subject matter of which amounts to hundreds of millions of RMB yuan. The case is a signature case in bond disputes in recent years. The court's determination on the liabilities of the brokerage firm and other intermediary service providers in the issuance of corporate bonds and the quantification of damages in the case will have important reference value for similar cases. The case is currently in the process of first instance trial.
