In one commercial disputes highlight, the team successfully represented the minority shareholders of Solar Industries India before the National Company Law Appellate Tribunal. The case revolves around a petition filed by the vice-chairman of the company, alleging acts of oppression and mismanagement by the majority shareholders of Solar Industries and by other members of the board.
The competition team successfully represented the Builders Association of India (BAI) before the Madras High Court in writ petitions filed by India Cement and Dalmia Bharat Cement challenging the impleadment of BAI as an interested party in a cement cartel investigation by the competition regulator. This was the first judgment in competition law jurisprudence to deal with ‘comity of courts’ and ‘territorial jurisdiction’ of the High Court.
