In the area of construction and real estate, the team represented a number of clients last year. Among them, the team represented three real estate development companies in an arbitration case in which the other party
claimed costs for inferior quality. The case involved a dispute between the parties over the contract billing method and basis of billing, and there was a disputed amount of Rmb135 million ($19.5 million). The case is ongoing.
In another case, the team represented a party to a co-operative development and won a lawsuit against the other party claiming shareholder’s loan and liquidated damages. According to the report, the case was named as equity transfer dispute but was actually a private lending dispute – and through the correct understanding and definition of the true legal relationship between the two parties, the amount of liquidated damages was successfully adjusted down to one-fifth of the original amount.
