In a ground-breaking case, the firm acted for Allergan, a multinational pharmaceutical company and maker of well-known anti-aging product Botox, in a case addressing the question of whether the use of a competitor’s trademark by a competitor to promote the competitor’s product, infringes the registered trademark. This was the first case in Australia dealing with a defensive trademark registration. The outcome of the case will set an important precedent for brand owners that are considering using a competitor’s products and associated trademarks as part of their own marketing strategy.
