It has been successful in identifying and taking civil action against a third party that has adopted an identical mark in an identical colour combination for identical services. The third party is evidently attempting to dilute the client’s trademark and riding on its hard-earned reputation and goodwill. The client has instituted a passing off claim against the third party, with the case being referred for mediation since the infringer has claimed to amend its logo. The matter is pending before the High Court for adjudication.
