Dispute resolution

Founded in 1994, Poblador Bautista & Reyes is a top-tier firm in dispute resolution and its partners are recognised as star litigators in the country. The firm has extensive experience in the fields of commercial litigation and arbitration, government and regulatory, insolvency and intellectual property. It is a go-to firm for big-ticket litigation as well as international arbitration, notably active in the energy and infrastructure sectors.

Alexander Poblador, Gilbert Raymund Reyes, Mario Luza Bautista and Dino Viviencio Tamayo are recommended for their commercial and regulatory disputes expertise, while Bautista and Tamayo are also noted for their respective experience in insolvency and intellectual property.

In the government and regulatory space, the team is representing SMC Mass Rail Transit 7, a rapid transit line under construction in the Philippines, in proceedings before the Court of Appeals to challenge the Court of Appeals’ earlier decision to direct the government to deposit an additional amount of P3.8 billion (on top of the initial deposit of P648 million). This is a major expropriation case involving one of the country’s key public-private partnership projects, which seeks to alleviate the traffic problems in the metropolis.

The firm’s IP team is representing Intel in various actions and proceedings before the Intellectual Property Office, the Department of Trade and Industry, and the Securities and Exchange Commission to secure the cancellation of names and marks that infringe upon Intel’s world-famous trademarks. The firm is involved in the execution and implementation of Intel’s worldwide trademark protection initiative in the Philippines.

The IP litigators were triumphant for its client, major international garment manufacturer Levi Strauss & Co, in protecting its ‘Levis’ trademarks. The Supreme Court issued a landmark decision in favour of the firm’s client. The High Court noted that the marks are used on competing goods, and that the actual product labels are “very much similar with one another” and have “the same look and feel”.

The firm’s recent client roster also includes Alltech Contractors.
