Dispute resolution

Saraf and Partners was established three years ago. It has a fully fledged dispute resolution offering that encompasses litigation, domestic and international arbitration, and other forms of dispute settlement. The firm’s formidable corporate transactional capability dovetails nicely with its contentious practice, as exemplified by its projects litigation and insolvency litigation groups. The practice has been active in high-stakes commercial disputes around India, as well as in specialised advisory and representation in international and cross-border challenges. The firm also has a skilled and experienced white-collar crime team. It has specialities in energy, contractual, consumer, insurance, competition, antitrust and defamation cases. The firm further strengthened its real estate practice by merging with SRGR Law Offices, a boutique real estate law firm with a team of 20.

The 10 partner-strong dispute resolution team is led by founder Mohit Saraf. Other core members include Manmeet Singh, Sanjeev Sharma, Vaibhav Kakkar and Abhishek Swaroop. The group welcomed disputes-focused partners Anugrah Robin Frey, Sairam Subramanian, Vijay Kaundal and Anirudh Krishan Gandhi from L&L Partners, Shardul Amarchand Mangaldas & Co, SRGR Law Offices and LALIVE, respectively.

The team successfully represented Fortis Healthcare and Fortis Hospitals (Fortis Group) against Daiichi Sankyo (Daiichi) in several petitions stemming from the enforcement petition of an arbitral award. Certain disputes arose between the parties in relation to an alleged misrepresentation in the sale of the business Ranbaxy to Daiichi. As a consequence, Daiichi initiated arbitration proceedings in Singapore and secured a foreign arbitral award in its favour. The Supreme Court decision rendered in the Ranbaxy-Daiichi feud was a landmark one and has become precedent in the context of the enforcement of foreign awards, as well as the scope of contempt proceedings in India.
