  • Mr. Kaba secured a complete defense verdict for Disney in a high-profile suit brought by an animator who alleged Disney infringed his similar project to develop the blockbuster film, “Moana.” The plaintiff, Buck Woodall, alleged he had passed his materials to a family member who worked on a Disney lot, but the jury decided that the creators of “Moana,” which earned nearly $700 million at the global box office, never had access to the plaintiff’s outlines and script for “Bucky the Surfer Boy.”

  • Mr. Kaba obtained over $500 million in trial damages for Monster Energy in a pair of precedent-setting cases against rival beverage company Vital Pharmaceuticals (VPX), the third-largest energy drink manufacturer in the U.S. The trials included a $293 million false advertising, tortious interference and trade secrets theft verdict that is believed to be the largest Lanham Act award in history, and a case that is among the largest-ever U.S. trademark awards, which resulted in $175 million in damages, nearly $10 million in attorney’s fees and costs, and a 5% royalty on all future sales of VPX’s Bang Energy product (with over $1.5 billion in annual sales). 

  • Mr. Kaba won a “landmark” opioid trial for Endo Pharmaceuticals in a $50 billion action. Three of the most populous counties in California and the City of Oakland brought suit against opioid manufacturers alleging false advertising, unfair competition and public nuisance. The jurisdictions claimed that manufacturers’ alleged false and misleading marketing caused a $50 billion public nuisance. The win was hailed in American Lawyer as “giv[ing] drug companies their first major victory in the litigation brought by cities and counties across the country over the opioid crisis.”

  • As lead trial and appellate counsel for Amazon and Twitch, Mr. Kaba secured a first-of-its-kind decision in New York state, with the New York appellate court dismissing lawsuits alleging his clients and other social media companies were liable for a fatal mass shooting in Buffalo, New York. The plaintiffs—victims of the shooting and their family members—contend the shooter was radicalized by extremist and racist content on social media and that his ability to livestream on Twitch motivated him to commit the crimes. The claims included wrongful death, product liability, negligence, and infliction of emotional distress.

  • Among many other high-profile, cutting-edge cases, Mr. Kaba recently argued and prevailed at the California Court of Appeal for McDonald’s USA, convincing the court to unanimously affirm the dismissal he obtained of a $100 million fraud suit brought by Byron Allen over ad spend on black-owned media through a motion under California’s “anti-SLAPP” statute. He also argued and prevailed at the U.S. Court of Appeals for the Ninth Circuit for Amazon in a nine-figure lawsuit brought by Planet Green Cartridges, which accused Amazon of false advertising on Amazon.com. Additionally, Mr. Kaba is representing the major record labels, including UMG Recordings, Warner Music Group and Sony Music Entertainment, in high-profile and high-stakes copyright litigation against two leading generative AI music companies, Suno and Udio. The lawsuits are the first time the labels have sued AI companies over sound recording copyrights.
