Lionel M. Lavenue focuses his practice on patent trial litigation and strategic patent portfolio management. With experience in over 220 patent cases, Lionel has served as lead counsel in more than 60 district court litigations, including extensive work in the Eastern District of Texas. He has handled nearly a dozen patent infringement matters under 28 U.S.C. § 1498(a) before the U.S. Court of Federal Claims, over a dozen Section 337 disputes before the U.S. International Trade Commission, and multiple arbitrations.

Lionel has argued dozens of Markman hearings and directed discovery in complex disputes, taking or defending more than 250 depositions. He has also briefed and argued numerous appeals before the U.S. Court of Appeals for the Federal Circuit.

In addition to litigation, Lionel has prepared nearly 2,500 patent applications and manages large domestic and international patent portfolios. His prosecution experience spans technologies in financial services, electrical systems, aerospace, automotive, and medical devices. He works closely with innovators in artificial intelligence (AI), advising on patent strategy for machine learning, data processing, and automated decision-making technologies.

Lionel’s practice includes opinion work and litigation involving business methods, software, and mechanical/electrical devices. He has directed nearly 100 defensive patent reexaminations and led the filing of almost 200 inter partes review (IPR) and covered business method (CBM) petitions, including some of the earliest IPR challenges.

With deep experience in government contract-related patent disputes, Lionel holds Public Trust clearance and previously held Top Secret and Code Word clearances. A Fulbright Scholar, he studied international IP law at the Max Planck Institute in Munich. Lionel frequently lectures on IP issues in aviation and aerospace, including UAV and rotorcraft technologies. He is recognized by several leading legal publications for his national and regional excellence in patent law.

  • Ad Innovations, LLC v. BMW of North America, LLC, 3:25-cv-00179, S.D. Tex.
    Represented BMW Group in a patent infringement suit filed by non-practicing entity Ad Innovations, LLC, which alleged that BMW 7 Series sedans infringed U.S. Patent No. 8,594,341, covering systems for switching between multiple audio channels using interior microphones. The suit, filed in June 2025, was voluntarily dismissed just two months later when Ad Innovations conceded it could not prove infringement. Finnegan secured a swift, cost-effective dismissal of the case.

  • Beacon Navigation GmbH v. Bayerische Motoren Werke AG et al, 1:11-cv-00931, D. Del.; Certain Automotive GPS Navigation Systems (Beacon Navigation v. Audi), 337-TA-814, ITC; Beacon Navigation GmbH v. Bayerische Motoren Werke AG et al, 2:13-cv-11410, E.D. Mich.
    Represented BMW Group against Beacon Navigation in a complex investigation involving 50+ automobile manufacturers and, in 2024, brought the 13-year patent litigation saga to a close. Beacon sued BMW in the District of Delaware, asserting three patents directed to improved navigation systems, including U.S. Patent No. 5,862,511, and filed a parallel ITC investigation. While others settled, BMW persisted, refusing to capitulate with a settlement. After strategic venue transfers, stays, and six USPTO reexaminations, Beacon was left with only two surviving claims. Despite years of litigation, Beacon failed to produce evidence of infringement. Its expert’s report, based solely on software code, confirmed non-infringement. The Michigan court granted summary judgment in BMW’s favor, ending Beacon’s campaign.

  • Bayerische Motoren Werke AG et al v. Arigna Technology Limited, 1:23-cv-01190, D.D.C.
    Represented the BMW Group in a declaratory judgment action for noninfringement and invalidity of U.S. Patent No. 8,289,082, as part of its long-fought battle against Arigna, in which the court dismissed Arigna’s counterclaim of patent infringement with prejudice. This dismissal came after BMW secured a royalty free covenant-not-to-sue on the asserted patent, ensuring that Arigna cannot reassert its claims. This outcome represented a definitive victory for BMW, bringing a close to U.S. litigation surrounding the ’082 patent, the last of four patents initially asserted by Arigna as part of its broader enforcement campaign.
