Jason J. Annibale is the co-leader of McMillan LLP’s Construction & Infrastructure Group and is recognized as one of Canada’s top construction, infrastructure, and energy lawyers. He represents a wide range of clients, including authorities, lenders, contractors, owners, and special purpose vehicles in complex construction disputes, restructuring matters, and sophisticated project finance transactions. Jason is an experienced litigator and arbitration counsel who has appeared at every level of court in Ontario.
He has acted on major disputes involving delays, cost overruns, force majeure (including COVID 19 impacts), scope changes, owner interference, and other challenges across significant infrastructure projects such as rail transit systems, underwater tunnels, prisons, hospitals, power stations, schools, and commercial developments.

A respected authority in construction law, he frequently speaks on the Construction Act, prompt payment, adjudication, delay and impact claims, dispute resolution, and risk management.

He is a fellow of both the Canadian College of Construction Lawyers and the Construction Lawyers Society of America. Jason co-chairs Osgoode Hall’s major construction law programs and has served multiple terms on the Ontario Bar Association’s Construction and Infrastructure Law Section Executive. He has authored and co-authored major texts on public private partnerships, construction disputes, prompt payment, and adjudication.
