Robert J. Hawkes, KC, is lead counsel in complex corporate oppression actions, shareholder derivative actions, class actions, defamation actions, and investment advisor negligence claims. Robert practised as an associate and partner at one of Canada’s leading firms from 1993 until 2005, gaining experience in virtually all areas of defamation and corporate and commercial litigation.
In 2005, Robert joined JSS Barristers, where he has continued his high‑level commercial litigation practice, leading trials, appeals, arbitrations, mediations, discipline hearings, and other administrative law matters. Robert also acts for a number of media outlets in media and defamation matters.

  • JSS Barristers represented 420 Investments Ltd., a privately owned company operating retail cannabis stores in Alberta. In August 2019, Tilray, High Park and 420 entered into an arrangement agreement pursuant to which Tilray and High Park would acquire 420 for a total of C$110,000,000 in cash and/or shares. The transaction was terminated in February 2020, after which 420 commenced a breach of contract action. The matter settled prior to trial in 2025.

  • JSS Barristers is counsel to Jason Mann in a series of oppression actions in which he is both plaintiff and defendant concerning control and ownership of a group of companies engaged in the sourcing and supply of agricultural chemicals and fertilizer in Western Canada. The dispute value is in the mid‑seven figures. The matter has created significant Saskatchewan jurisprudence confirming that contested oppression matters should not be determined solely on affidavit evidence. The primary defendant was recently declared a vexatious litigant.

  • JSS Barristers is lead counsel for an Alberta First Nation in a broker negligence claim. The value of the claim remains undetermined. Trial is scheduled for March 2027.
