Recent case highlights:
We are assisting a Philippine subsidiary of one of the world's leading cement suppliers in a commercial arbitration under the Rules of the Philippine Dispute Resolution Center, Inc. The case involves the termination of a Port Services Agreement by the client. We were instructed by the client to represent it in Emergency Arbitration proceedings against the counter-party. The value of the dispute is around PhP1.8 Billion.

We obtained a favorable decision from the Emergency Arbitrator on behalf of the client. The Emergency Arbitrator issued an emergency award revoking a PhP1.8 Billion garnishment issued by the court against the client. However, the court refused to lift the garnishment on the basis of the emergency award. A related application for interim measure, which could modify or affirm the emergency award, is pending with the Arbitral Tribunal.

The issue of whether the Emergency Arbitrator can revoke a court-issued garnishment is novel and will likely reach the Supreme Court.”

Successfully assisted a multinational company engaged in the design, manufacture, and distribution of fashion, luxury, and sport eyewear products in investigation and subsequent enforcement/raid against ten establishments owned by six related entities in Manila that are engaged in the large-scale and widespread sale and distribution in the Philippines of counterfeit eyewear products bearing our client’s trademarks and designs. The raids resulted in the seizure of 323,141 pairs of counterfeit eyewear products with an estimated value of USD 31,350 million, one of the largest seizures that our client has had in the past few years.
