Goldman Ismail

At Goldman Ismail’s Chicago officeRami Fakhouri litigates complex commercial and product liability disputes both at trial and on appeal. Fakhouri currently works alongside fellow 40 & Under stars Allyson Julien and Emma Ross– also based in Chicago –serving as lead national counsel to Merck & Co. in all ongoing product liability matters in US courts relating to the company’s HPV vaccine, Gardasil. These numerous matters entail complex, novel questions as to pre-emption, medical causation, and the National Childhood Vaccine Injury Act of 1986. Chicago partner Andrew Rima is also active on the life sciences product liability front, serving as lead trial counsel to AbbVie in bellwether multidistrict litigation(MDL) regarding the company’s testosterone replacement therapyAndrogel. A complete defense verdict has been returned for Abbvie, and Rima and the Goldman team continue to represent the client in ongoing related opt-out matters.

Also at the firm’s Chicago office, product liability, antitrust, and commercial litigator Jennifer Greenblatt serves as lead counsel to Lafarge North America in opt-out antitrust litigation brought by Home Depot the United States’ largest purchaser of drywall – arising from allegations that Lafarge carried out a drywall price-fixing conspiracy in violation of the Sherman Act. Despite Home Depot’s desire not to work in conjunction with plaintiffs in an already pending MDL against the client concerning the same allegations. Greenblatt and the Goldman Ismail team saw success not only in transferring Home Depot’s case to the MDL, but also in obtaining a rulingwhich struck down Home Depot’s expert reports with leave on a ruling for summary judgement. Home Depot is pursuing interlocutory appeal of the decision before the Third Circuit. Greenblatt is joined on the Lafarge matter by new 40 & Under partner Laura Sexton, serving in a supporting capacity.

Chicago partner Doug Winnards practice is centered around the litigation of intellectual property, commercial, and product liability disputes. Winnard has recently been retained by Apple for representation in multiple regards, including successfully representing the company in an IP dispute brought last year by patent troll Uniloc USA, and an ongoing IP dispute brought against the company by headphones manufacturer Koss Corporation.

Sidley Austin

New 40 & Under partner Steven Horowitz of Sidley’s Chicago office deals in IP and antitrust litigation, his practice emphasizing the life sciences and technology industries. Following a widely spectated, monumental win on behalf of Amgen in a 2020 dispute with Sandoz relating to the client’s drug Enbrel, Horowitz more recently successfully represented solar technology company Longi Solar in the Federal Circuit of Appeals, defending an earlier win before the International Trade Commission. His work was instrumental in upholding a decision on behalf of the client which has prevented the blocking of the United States' emergent and remunerative solar panel market.

Also working from Sidley’s Chicago office is product liability litigator Michelle Ramirez, a newly minted partner on the 40 & Under List. Ramirez represents industry leaders – hailing especially from the pharmaceutical, medical device, manufacturing, and consumer goods sectors – at all stages of litigation and trial. She currently serves in a lead role on the firm’s national and coordinating counsel teams representing Bayer in high-exposure product liability litigation relating to the client’s Essure permanent birth control. Ramirez has been instrumental in achieving favorable settlements of the greater majority of claims for Bayer in this still-ongoing matter.
