Chan-Keun Park

Chan-Keun Park is a partner and a deputy chair of Yoon & Yang’s Employment & Labour Practice Group. Chan-Keun Park represents clients in all capacities and has experience litigating a wide breadth of business and employment-related disputes. He provides advisory and litigation services related to labor issues such as the flexible working hour systems, restructuring in the process of corporate M&A and business transfer, wage structures including ordinary wages, discrimination against fixed-term workers or temporary workers, occupational health and security, labor unions, and sexual harassment and bullying at workplace.

He has been constantly recognised as a Leading Individual in the field of Employment & Labour in South Korea by Chambers & Partners Asia-Pacific.

• Successfully represented Seoul Metro by reversing the decision of the appellate court at the Supreme Court in a case where retirees of Seoul Metro requested confirmation of their employment status from the Court claiming that they are expected to retire on the 31st of December of the year they turn 60 years old (retirement age in Korea) as opposed to their birthdays on the year they turn 60 years old.
• Successfully defended POSCO ICT in a discrimination case brought by its subcontracted workers by eliciting the decision that “there is no establishment of worker dispatch relationship between the company and its subcontracted workers and subsequently there is no discrimination for the workers.” As a consequence, the National Labor Relations Commission dismissed the case.
• Successfully represented Hyundai Motor Company (HMC) in a lawsuit filed by HMC’s employees, who claimed that their regular bonus should by nature be treated as ordinary wages and that they are entitled to additional overtime pay for work performed during holidays.
