Daniel Goldman is an accomplished courtroom advocate who tries high-stakes cases in jurisdictions throughout the country. Dan has prosecuted and defended numerous cases, both jury and nonjury, and arbitrations in New York, California, Texas, Delaware, Massachusetts and Washington, D.C.
Representing a class of consumer packaged goods companies including Procter & Gamble, Heinz and Dial Corp., Dan obtained, after opening statements, a $250 million settlement in an antitrust case against News Corp. alleging that News monopolized the third-party in-store promotions market. In approving the settlement, the U.S. District Court for the Southern District of New York lauded Dan as being among the “finest antitrust lawyers in the nation” and said that the settlement “represents an outstanding result.” The American Antitrust Institute recognized this settlement as an “outstanding litigation achievement in private law practice.”
Dan, after a weeklong bench trial, defeated an attempt by DuPont Co. to enforce — in New York — a $920 million judgment against Dan’s client, Korean chemical manufacturer Kolon Industries (a judgment that was subsequently reversed by the Fourth Circuit Court of Appeals). After a jury trial lasting a week and a half, he secured a multimillion-dollar verdict for TydenBrooks against defendant Cambridge Security Seals for misappropriation of trade secrets, unfair competition and unjust enrichment relating to the theft of a proprietary manufacturing process. He also obtained a dismissal with prejudice of a trade secret case brought against KPMG relating to an engagement with Manitoba Hydro, a Canadian power company, which was later affirmed by the Second Circuit Court of Appeals. In one of the largest employee raiding cases in New York, Dan represented numerous investment professionals who left U.S. Trust Co. to form a competitive investment firm, NewBridge Partners, settling the case favorably during trial.
Dan represents EIG Global Energy Partners in a $221 million fraud case against Petrobras, the Brazilian state-owned oil company, and in a related case against Keppel Offshore & Marine for aiding and abetting fraud. He is also representing The Procter & Gamble Company in an antitrust lawsuit against Union Pacific, BNSF, CSX and Norfolk Southern railways alleging a price-fixing conspiracy in violation of Section 1 of the Sherman Act.
In the commercial arbitration arena, Dan represented Hoechst Celanese in a yearlong, billion-dollar arbitration against Shell Chemical Co. to allocate between the companies the proceeds of a national class action settlement. He also represented Ernst & Young in arbitration relating to fee splits on capital leases of Dutch assets.
Dan has significant experience in bankruptcy-related litigation. He is leading the investigation of pre-petition transactions on behalf of the unsecured creditors committee of Toys R Us. He was also involved in the Adelphia, BearingPoint, Hostess and SLM bankruptcies.
