Recent matter/case highlights
 
Administrative Law, Collusion/Fraud case -   We represented one of the two plaintiffs, Confort Elite, a staffing agency in the healthcare sector accused of collusion and fraud. In this high-stakes case, we successfully obtained a stay of execution of a decision issued by Québec’s Autorité des Marchés Publics (AMP), which had removed our client from the registry of companies eligible to enter into contracts with government entities. This decision allowed our client to continue performing a $700 million contract. The case received extensive media coverage. The case is significant for two main reasons. First, upholding the AMP’s decision would have had devastating financial consequences for our client. Second, it raises critical legal issues regarding the nature and scope of the powers exercised by an administrative authority tasked with regulating contracts involving government entities.
 
Civil Liability and Insurance Case - We represent Emile Benamor, the owner of a historic property at the center of a significant dispute. This case involves claims totalling approximately $50 million, stemming from an arson that destroyed our client’s building in Old Montreal. The tragic fire resulted in the loss of seven lives and caused injuries to several others. We are defending our client against all damage claims brought by the victims and their families, while also pursuing a multi-million-dollar action against our client’s insurers. Over the past year, this case has garnered extensive media attention. The case raises complex and noteworthy legal issues, including: A property owner’s liability for occupant deaths caused by arson; Liability concerning damage to neighboring properties; The responsibility of Airbnb and its host, who rented multiple units within the building; The liability of the Montreal Fire Department. This matter not only highlights critical questions about liability and insurance but also has broader implications for legal standards in similar cases.
