Joshua E. Hollander is a litigation partner in Kasowitz’s New York office. He has over a decade of experience litigating high-stakes complex commercial, software and technology, real estate, securities and business tort cases throughout the country. Josh has represented global corporations and high-net-worth individuals in all phases of litigation, from pre-complaint investigations through trial and appeal, on both the plaintiff and defense side.

A significant portion of Josh’s practice relates to software and technology litigation. He actively represents companies and public entities in the recovery of damages arising out of failed implementations of enterprise resource planning (ERP) business software, and also represents technology clients in licensing disputes and trade secret misappropriation cases.

Josh was recognized by The American Lawyer Litigation Daily as a “Litigator of the Week” runner-up for securing a unanimous 5-0 decision from New York’s Appellate Division, First Department for an affiliate of The Georgetown Company, a leading diversified real estate company, affirming a trial court’s summary judgment decision that found construction firm J.T. Magen engaged in fraud related to a project at 787 Eleventh Avenue in Manhattan. Josh briefed and argued the First Department appeal. Josh has also been recognized by Best Lawyers on its Ones to Watch list.

Software and Technology Litigation

  • FinancialApps, a developer of financial services software, in its suit against Envestnet, a $3 billion wealth management software provider, and its subsidiary Yodlee, a consumer financial data aggregator, alleging theft of FinApps’ valuable proprietary information and trade secrets to unlawfully develop software products that compete with FinApps.

  • National Grid in an action against a software vendor stemming from a $1 billion implementation of SAP software.

  • Lubrizol, a global specialty chemicals company, in an action against IBM stemming from an implementation of SAP S/4HANA.

  • W.C. Bradley in an action alleging fraud and breach of contract stemming from an implementation of SAP software.

  • Levi Strauss & Co. in an action against Deloitte Consulting stemming from an implementation of SAP’s apparel and footwear software.

Complex Commercial, Real Estate and Securities Litigation

  • The Georgetown Company, a leading diversified real estate company, in securing summary judgment dismissing all claims with prejudice against Georgetown, voiding an $11 million mechanic’s lien, and on fraud counterclaims against construction firm J.T. Magen related to a construction project at a commercial building Georgetown owns in Manhattan. New York’s Appellate Division, First Department unanimously affirmed (5-0) the summary judgment decision.

  • An industrial conglomerate in a jury trial pursuing securities fraud claims for insider trading and market manipulation against a major investment bank.

  • International financial institutions seeking to recover more than $3.5 billion procured in breach of lending agreements involving variable funding notes.
