  • Lawyer Liu was entrusted by a state-owned asset management company to handle disputes over a 7-billion-yuan non-performing legacy credit risk project involving Dongxu Group. This case is a major debt restructuring case of listed companies in Hebei Province, and also a debt restructuring achieved through collaboration among local governments, courts, and multiple financial institution creditors. The debtor, Dongxu Group Co., Ltd., faced debt liabilities amounting to hundreds of billions of yuan, and achieving debt restructuring is crucial to its survival. Additionally, the legal relationships involved in this case encompassed diverse transaction models, including entrusted bank loans, equity repurchases, and collective fund trust loans. While vigorously promoting the litigation, arbitration, and enforcement procedures of the case, Lawyer Liu conducted a comprehensive analysis of the feasibility and compliance of the debt restructuring, and ultimately helped the client achieve phased debt restructuring. Instead of relying on traditional court mediation, litigation, or arbitration procedures, the parties signed a debt restructuring agreement outside of court facilitation. This innovative model not only resolved the dispute efficiently but also helped the client accomplish the goal of phased risk resolution.
