Glenn Solomon, KC, BA, LLB, LLM, LLM, FCIArb, ICDD, is a senior partner at JSS Barristers.   • Clearview AI Inc v Alberta (Information and Privacy Commissioner), 2025 ABKB 287. This case arises out of a joint investigation of the Privacy Commissioners of Alberta, British Columbia, Quebec and Canada regarding internet scraping, collecting, and analysing of images of people undertaken by Clearview, which in turn is used to obtain facial recognition data, and then sold for commercial purposes. The Privacy Commissioners jointly issued a report on the matter. The Privacy Commissioners of Alberta, British Columbia and Quebec then issued Orders prohibiting the activities. Clearview AI brought a Judicial Review in each of the subject jurisdictions. Mr. Solomon acted for the Alberta Privacy Commissioner on the Judicial Review. The case was determined by the Alberta Court of King’s Bench. Clearview AI Inc v Alberta (Information and Privacy Commissioner), 2025 ABKB 287 (CanLII), <https://canlii.ca/t/kc1r5>. The Court upheld the decision of the Privacy Commissioner. Clearview has appealed the decision to the Court of Appeal.

  • Northback Holdings Corporation v Alberta (Environment and Protected Areas), 2025 ABKB 617 (CanLII), <https://canlii.ca/t/kg6fb>. Through 3 Judicial Review Applications, Northback sought orders in the nature of mandamus against the Privacy Commissioner to compel the Privacy Commissioner to prioritize Northback’s matters. This kind of relief had not previously been addressed in cases against the Privacy Commissioner. This is an important case in terms of addressing the Privacy Commissioner’s status as an Officer of the Legislature, the nature of the Privacy Commissioner’s functions and procedures, and the high threshold for relief in the nature of mandamus as against a regulatory body engaging in an adjudicative function. We acted for the Alberta Privacy Commissioner. The Court of King’s Bench dismissed Northback’s Applications. Northback has appealed to the Court of Appeal. The matter is ongoing.
