2023 年12 月12 日，最高人民法院就《最高人民法院关于审理劳动争议案件适用法律问题的解释（二） （征求意见稿）》（以下简称“《意见稿》”）向社会公开征求意见，虽然只是一份“征求意见稿”，但相较之前 2021 年1 月1 日施行的《解释（一）》更多是将之前的四个司法解释进行整合，本次《意见稿》中不少内容 与目前司法实践的情况还是有明显的差异，并出现了不少新的观点，值得予以充分关注。
