The team acted for the operational creditors of Binani Cement in a case that laid a legal precedent for the protection of rights of operational creditors during a resolution under the IBC in India. The team was equally instrumental for Honest Shelters in a long-running real estate dispute relating to a project known as “Palais Royale” in Mumbai. The legal issues involved in the case include whether temporary structures on common access forming part of the property were in a dilapidated state, whether the client was entitled to seek demolition of those structures, and whether ordering demolition would mean dealing with assets of a corporate debtor undergoing a corporate insolvency resolution process. The case also involved determining the jurisdiction of the Bombay High Court or the National Company Law Tribunal in deciding the issue.
