Dispute resolution

K&L Gates’ dispute resolution practice is active in commercial and transactions. The firm has experience handling debt restructuring, fraud, professional liability, and contentious employment matters, as well as construction, securities and investment company litigation. In addition, it has been handling an increasing number of technology and intellectual property related disputes.

Key people include Christopher Tung and Sacha Cheong, two Hong Kong-based partners. Tung is active in construction, environmental law, clean energy and carbon finance. Cheong specialises in commercial cases, white collar crime, employment and construction. Jay Chiu is another key contact.

In a commercial dispute, the firm is assisting China Silver in several funds-related litigation matters arising from swap transactions and redemption rights under subscription agreements. These matters are ongoing before the Court of First Instance and Court of Appeal in Hong Kong and have also given rise to parallel proceedings in the Cayman Islands as well as winding-up and bankruptcy proceedings in Hong Kong.

In the IP space, the firm is representing Luxshare Precision, one of the biggest and best-known connector companies in China, in patent litigation in response to a patent infringement claim brought by its competitor for the usage of certain electrical connectors and cages in downstream products sold in the US. The case was first filed in 2020 and the firm received a favourable final initial determination from the administrative law judge in March 2022.

In January 2022, the firm welcomed Susan Munro as counsel to the international arbitration team in Hong Kong.

Some of the firm’s new clients are FTI Consulting, Grant Thornton, Hong Kong International Aviation Leasing, Lexington, PricewaterhouseCoopers, Wuyi Bairong Electric Appliance and ZTE Corporation.
