Dispute resolution

Lusheng Law Firm mines a unique niche exclusively dedicated to intellectual property. It is also a patent agency authorised by the China National Intellectual Property Administration. With headquarters in Beijing, the firm has also set up branches in Shanghai and Guangzhou to provide patent agency services to clients across China.

Managing partner August Zhang specialises in the areas of trademark, copyright, trade secret and unfair competition and he often advises clients with the security and enforcement of their valuable IP assets in the region. Sharon Qiao, Beijing-based Landy Jiang and Shanghai-based Carol Wang are key figures.

Among the IP litigation, the firm successfully represented major sports footwear and apparel manufacturer New Balance Athletics in a series of trademark infringement and unfair competition disputes against Chinese brand New Barlun. Shanghai IP Court rendered the final judgments in 2022 for all three cases in the series and confirmed that New Balance’s ‘N’ trademark had become special decoration of well-known commodities before August 2004. New Balance was awarded total damages of Rmb35.8 million ($4.9 million). This is a legendary IP battle between New Barlun and New Balance considering New Barlun’s influence and position as the originator of parasite ‘N’ marked sporting shoes as well as the long infringement history. The courts restored the truthful fact that New Barlun was a malicious infringer under the cover of legitimate trademark owner.

Notable IP clients include Babyzen, Lululemon Athletica, Spin Master, Universal City Studios and Universal Pictures.
