In a construction dispute, the firm acted for a construction contractor in a Construction Industry Payment and Adjudication Act (CIPAA) claim against a main contractor for non-payment relating to two construction agreements filed at the Asian International Arbitration Centre. The main contractor raised defences including delays, counterclaims on defective work, the need to hire new contractors, and overclaiming. The adjudicator ruled in favour of the firm’s client. Dissatisfied with the decision, the main contractor filed an application to set aside the CIPAA adjudication decision and requested a stay. After extensive arguments and submissions, the court sided with the firm’s client, dismissing the main contractor's application to set aside the decision and stay its enforcement.
