Led by partners Antony Sassi, Samuel Hung and Carmel Green, with of counsel Annabella Chu, the team is handling complex issues around loss, causation and limitation defenses. The case, which follows a settled securities class action in Canada, raises novel legal points that may set precedents in Hong Kong, particularly regarding the application of recent English landmark decisions on auditor's scope of duty and contributory negligence.
In a parallel significant audit matter, the firm is representing PricewaterhouseCoopers in proceedings brought by liquidators of Hsin Chong Group, a major Hong Kong construction company known for building Ocean Park and Kai Tak Airport. Partners Antony Sassi and Samuel Hung are leading a challenge to established precedents regarding auditors' disclosure obligations, particularly the landmark Kwong Wah decision of 2003. Following recent English case law developments in Carillion (2021), the team achieved a partial victory in December 2023, securing a limited scope order for working papers disclosure, while preparing to defend against potential claims involving HK$11 billion ($1.43 billion) in problematic investments.
