Dispute resolution

Shihui Partners’ dispute resolution team is active in commercial and transactions. It often represents clients in commercial dispute resolution cases in courts at all levels, including the Supreme Court and local high courts. It also advises clients on dispute matters related to equity investments and commercial transactions. Key partners of the practice include Mingze Jiang, Jiayu Zhang, Yulong Lai, Jiaying Wang and Mingjiang Weng.

In a landmark financial dispute, Shanghai partner Mingze Jiang successfully defended JD Group in a Rmb30 billion ($4.2 billion) series of claims brought by Gopher Asset Management and Noah Holdings. The case centred on allegations of fraudulent factoring arrangements involving counterfeit seals and fabricated trade documents, where third parties had illegally exploited JD's platform credentials and office premises. The Shanghai Financial Court's groundbreaking decision exonerated JD from all liability claims, establishing crucial precedent for platform operators' scope of responsibility in supply chain financing. The case, spanning over six years and involving criminal and civil proceedings, has been recognised as a pivotal ruling that clarifies the boundaries of e-commerce platforms' obligations in preventing financial fraud.

Shihui Partners also provided advisory services to DHL logistics, Maoyan Group and Qiming Venture Partners in resolving disputes over the past 12 months.

In 2024, the firm strengthened its capabilities in dispute resolution and related practices through several notable hires and promotions. In February, Yuan Zhang joined as counsel from Liu Shen & Associates, specializing in intellectual property protection within the life sciences industry. In March, Jane Zhang was hired as a partner from Longfor Group, bringing expertise in dispute resolution alongside her experience in real estate and asset management. In April, Melinda Meng joined as counsel from Zhong Lun Law Firm, focusing on dispute resolution, health and life sciences, and regulatory compliance. In May, Huikai Wang was hired as a partner from King & Wood Mallesons, specializing in civil and commercial dispute resolution, including criminal and administrative cases, as well as non-performing asset disposal and bankruptcy reorganization.
