In the area of construction and real estate, the team represented a number of clients last year. Among them, the team represented three real estate development companies in an arbitration case in which the other party claimed costs for inferior quality. The case involved a dispute between the parties over the contract billing method and basis of billing, and there was a disputed amount of Rmb135 million ($19.5 million). The case is ongoing.

In another case, the team represented a party to a co-operative development and won a lawsuit against the other party claiming shareholder’s loan and liquidated damages. According to the report, the case was named as equity transfer dispute but was actually a private lending dispute – and through the correct understanding and definition of the true legal relationship between the two parties, the amount of liquidated damages was successfully adjusted down to one-fifth of the original amount.

East & Concord Partners’ Nanjing office’s dispute resolution team is led by a number of senior partners who have been practising for more than 10 years and specialise in commercial arbitration and litigation.

In 2022, the team provided full-process legal services for a commercial complex development in Nanjing. The project has a construction scale of about 120,000 square feet and a construction cycle of three years. It includes a large commercial elements such as a Hilton hotel and a shopping mall. At the same time, the project involved many legal services such as land transfer, EPC general contracting and international hotel construction management.

In another key case, the team represented Nantong Four Construction Group in its construction contract dispute with Taizhou Hengjing Real Estate Company. The case involved more than 20 controversial points, covering the settlement of the construction payment, the joint and several liability of one shareholder, the dispute between the parties over whether the payment conditions were fulfilled, and the dispute over the legal consequences of actual use without completion and acceptance. The case was reversed by the Jiangsu High People’s Court in the second instance, and the case put by the East & Concord Partners team was supported.
