Dispute resolution
Daniel M. Horowitz has been instrumental to Holwell Shuster & Goldberg’s success in a number of its most high-profile cases.
In one example, in ongoing, heavily contested multi-forum litigation, Daniel plays a leading role in the firm’s representation of Chubb on claims brought by major manufacturers, the nation’s largest drug distributors, and its largest pharmacy chains seeking insurance coverage for lawsuits seeking to abate the national opioid epidemic. Over the past two years, Daniel and the HSG team have secured key victories on summary judgment motions, forum fights, and discovery disputes across the cases. Specifically, Daniel was a principal member of the HSG teams that secured summary judgment victories against CVS and McKesson. These victories are serving as key precedents for other litigation across the country relating to insurance coverage for the opioid lawsuits (in many of which HSG and Daniel are representing Chubb).
Daniel also represents Chubb in a dispute with Meta concerning social media addiction lawsuits. The team recently secured a key win that returned the case to Delaware state court after Meta made extensive efforts to have the case litigated in California federal court.
Separate from representing Chubb, Daniel is part of the HSG team that represents Visa in its defense against claims brought by the country’s largest retailers, who are challenging the rules at the foundation of the modern payment card industry under the antitrust laws and seeking hundreds of billions of dollars in damages. The trial is scheduled for April 2026 and will be one of the most anticipated civil trials of the year.
Previously, Daniel was part of the HSG team that represented London Luxury, a home goods supplier, in a contract dispute with Walmart that alleged Walmart wrongfully cancelled a contract to purchase personal protective equipment. That case resulted in the HSG team securing a $101.2 million jury verdict against Walmart for its client.
Daniel is also a leader in the firm’s pro bono efforts, and his contributions have helped to secure HSG’s recognition from Law360 as the number one boutique in the nation for pro bono work, and Benchmark Litigation’s Pro Bono Firm of the Year. His recent representations include incarcerated individuals seeking to vindicate their constitutional rights, and clients in divorce actions through Her Justice. He also represented a Cuban asylum seeker who the United States deported to Cuba, yet Daniel successfully prevailed at the U.S. Court of Appeals for the Fifth Circuit to have the deportation order vacated, and helped facilitate his client’s return to the United States in coordination with ICE.
Following law school, Daniel served as a judicial law clerk to the Hon. Priscilla Owen (now Richman) of the U.S. Court of Appeals for the Fifth Circuit and the Hon. Frederic Block of the U.S. District Court for the Eastern District of New York.
He has been named to the Lawdragon 500 X – The Next Generation list and Benchmark Litigation’s 40 & Under List since 2024.
