Daniel Horowitz, partner at Holwell Shuster & Goldberg LLP, has been instrumental to the firm’s success in a number of its most high-profile cases.
In one example, in ongoing, heavily contested multi-forum litigation, Daniel plays a leading role in the firm’s representation of Chubb on claims brought by major manufacturers, the nation’s largest drug distributors, and its largest pharmacy chains seeking insurance coverage for lawsuits seeking to abate the national opioid epidemic. Over the past two years, Daniel and the HSG team have secured key victories on summary judgment motions, forum fights, and discovery disputes across the cases, including against key pharmaceutical industry players CVS, Kroger, and McKesson. Those victories are serving as key precedents for other litigation across the country relating to insurance coverage for the opioid lawsuits (in many of which HSG and Daniel are representing Chubb).
Daniel is also heavily involved in HSG’s representation of Chubb in litigation in Superior Court in Delaware concerning coverage for numerous underlying claims related to Mattel and its subsidiary Fisher Price’s Rock ‘n Play baby sleeper. After an early loss in a critical matter, in summer 2023, Chubb brought in HSG to lead its defense and turn the tides. Since, Daniel and the HSG team have secured several victories on issues of substantial importance to their client. The litigation is in the midst of discovery, with one summary judgment motion already pending and more forthcoming. Daniel also represents Visa in “swipe fee” antitrust litigation brought by some of the nation’s largest merchants.
Daniel was also recently part of an HSG team that represented London Luxury in a contract dispute against Walmart in a case that resulted in a $101M verdict in favor of HSG’s client.
Beyond his high-stakes commercial litigation practice, Daniel also represents clients in significant constitutional challenges. He has defended the Public Campaign Financing and Election Commission of the State of New York against a challenge to its authority to issue recommendations to establish a public campaign financing program in New York State, and the Governor of the State of New York in a challenge to a statute related to salaries for legislators and executive-branch employees.
Daniel is also a leader in the firm’s pro bono efforts, and his contributions have helped to secure HSG’s recent recognition from Law360 as the number one boutique in the nation for pro bono work, and Benchmark Litigation’s Pro Bono Firm of the Year. His recent representations include incarcerated individuals seeking to vindicate their constitutional rights, and clients in divorce actions through Her Justice. He also represented a Cuban asylum seeker who the United States deported to Cuba, yet Daniel successfully prevailed at the U.S. Court of Appeals for the Fifth Circuit to have the deportation order vacated. Daniel thereafter helped facilitate his client’s return to the United States, who will be eligible for a green card in a manner of months.
Following law school, Daniel served as a judicial law clerk to the Hon. Priscilla Owen (now Richman) of the U.S. Court of Appeals for the Fifth Circuit and the Hon. Frederic Block of the U.S. District Court for the Eastern District of New York.
