Eric Alan Stone is a highly accomplished trial lawyer with over 25 years of experience trying cases in state and federal courts and in domestic and international arbitrations, as well as on appeal.

Eric’s patent practice spans the full gamut of biotechnology and pharmaceutical cases. He represents innovators under the Biologics Price Competition and Innovation Act and the Hatch-Waxman Act. He has been lead counsel in cases involving recombinant protein expression, DNA sequencing, the use of antibodies to treat cancer, osteoporosis, and hemophilia, the development of innovative technologies to harness and repurpose the immune system, and the innovation of diagnostic and manufacturing technologies.

Eric was lead counsel to Genentech in a precedent-setting case against Baxalta involving HEMLIBRA®, a life-changing treatment for hemophilia A and one of Genentech’s blockbuster products. Eric defeated Baxalta’s application for a preliminary injunction, won summary judgment invalidating Baxalta’s patent, and successfully defended that decision in the Federal Circuit’s first decision addressing the enablement requirement in the wake of the Supreme Court’s decision in Amgen. Eric is also co-lead counsel in a district court case for Amgen regarding the use, in treating osteoporosis, of its blockbuster antibody Evenity® in combination with antiresorptive drugs. Eric is also lead counsel to Natera, a clinical genetic testing company, in a district court proceeding involving Signatera™, Natera’s DNA-based diagnostic test that can determine whether a previously treated patient’s cancer has returned, years before the recurrence would be detectable on an MRI or CAT scan.

Eric is regularly recognized for his work in patent litigation by leading life science, IP, and legal publications. This year he has been shortlisted for New York Patent Litigator of the Year by LMG Life Sciences, named to Managing IP’s IP Stars List, and listed as a silver ranking in the IAM Patent 1000 Leading Patent Litigators. He is regularly recognized for his work by Chambers USA, The Legal 500 and Benchmark Litigation. Eric is an adjunct professor at the New York University School of Law, where he teaches patent litigation. For many years, he co-authored a regular column for the New York Law Journal on intellectual property litigation.

Eric also maintains an active pro bono practice. He is a trustee of the Lawyers Committee for Civil Rights Under Law and has represented clients in impact and individual pro bono cases in the areas of search and seizure, medication-assisted therapy for narcotic addiction, LGBTQ+ rights, medical privacy, and prison confinement conditions, to name only a few.
