Geng Chen represents both plaintiffs and defendants in all types of commercial litigation in federal courts, state courts, and arbitrations across the country. Chen has amassed an impressive collection of litigation victories and favorable settlements for clients who vary from Fortune 500 industry leaders to classes of unfairly treated plaintiffs in several national class action lawsuits.
Chen is representing the City of Baltimore – whose citizens are more likely to die of an opioid overdose than those of nearly any city in the U.S. – in its ongoing opioid litigation. Thus far her team has secured over $400 million for the city in deals with Cardinal Health, Johnson & Johnson, CVS and Allergan.
Chen and a team from Susman Godfrey have secured multiple settlements with various banks accused of conspiring to rig LIBOR in In re: Libor-Based Financial Instruments Antitrust Litigation. Settlements to date are just over $781 million, all for the benefit of a class of plaintiffs that includes cities, nonprofits, and others known as the “over-the-counter” purchasers. This plaintiff class represented by Chen and the Susman Godfrey team was also the only proposed class in the multidistrict litigation to win class certification.
In Melissa Ferrick et al. v. Spotify USA Inc., Chen helped obtain final approval of a favorable settlement valued at over $100 million on behalf of a class of songwriters and composers. The deal included a $43.45 million cash fund and an agreement by popular online music streaming service Spotify to pay future royalties, as well as provide additional valuable prospective relief.
Chen previously represented GE in a lawsuit in New York state court concerning a highly complex dispute over a tax indemnification agreement signed as part of Swiss Re’s $6.8 billion purchase of GE’s reinsurance business in 2005. She also served as trial counsel for a certified class of thousands of investors in GAW Mining LLC who allege that the cryptocurrency mining venture in which they invested was in fact a Ponzi scheme.
In Kao v. Onyx Renewable Partners Chen represented the former CEO of a renewable energy company alleging contractual and discrimination claims against her former employer that resulted in a very favorable settlement.
Chen takes seriously her commitment to representing all people who seek justice, no matter what their economic status. She recently secured a win before the Second Circuit in a pro bono case involving unconstitutional detention of a client past his prison release date that opened the door to punitive damages. Before that she represented pro bono a whistleblower in a case arising out of illegal landlord practices that targeted vulnerable tenants in multiple neighborhoods in New York. In that case, an aggressive litigation strategy led to an early, favorable settlement for her client.
Chen joined Susman Godfrey after clerking for the Hon. Jacques Wiener Jr. of the United States Court of Appeals for the Fifth Circuit. Before that time, she attended Harvard Law School, where she was an Executive Editor of the Harvard Law Review and a semifinalist in the Ames Moot Court Competition.
