Kevin has a broad civil litigation practice and has successfully represented clients in a range of contentious and non-contentious matter.
Kevin has acted in numerous public law matters, including constitutional, administrative, environmental, aboriginal law and human rights cases. In acting for a group of environmentalists attempting to halt a road construction project, he and his team appeared in court nine times in a ten-week period, obtaining an interlocutory injunction which was upheld by the Court of Appeal. In a recent constitutional challenge to a municipal by law Kevin brought on the basis that it infringed freedom of expression, the Court issued an order requiring the City to correct the provision.
Many of Kevin’s cases have a civil society dimension to them. He often takes on public interest matters, including on a pro bono basis, and many of his cases have attracted substantial media attention. He currently acts in two civil proceedings for groups of women who have been the subject of criminal voyeurism. He regularly advises charities, not-for-profits, and faith organizations both in relation to non-contentious / governance issues, as well as in litigation. Those files often overlap with other aspects of Kevin’s practice, including estates litigation, employment law, and even class actions.
In corporate and commercial litigation, an area in which Kevin has received national recognition, he has taken on a range of business disputes, including breach of contract and negligence cases, construction disputes, shareholder fights, and oppression claims.
Kevin has had the good fortune to learn from talented and generous mentors throughout his career, including taking on Charter litigation with Joe Arvay Q.C., constitutional and administrative cases with Sean Hern K.C., and complex commercial matters with Robert Anderson K.C. and Mike Wagner, to name only a few. In turn, Kevin is committed to mentoring and supporting the next generation of legal talent, by regularly meeting with prospective or current law students and foreign-qualified lawyers interested in requalifying in Canada, involving summer and articling students and junior associates where possible in many of his cases, as well as acting as a sounding board or offering advice as younger lawyers begin to run their own files.
Outside the office, Kevin is active as a leader in a number of community organizations. As Vice-Chancellor (Deputy Chief Legal Officer) of the Anglican Diocese of New Westminster, he has assisted with matters ranging from giving opinions on Canon Law to reviewing parishes’ Covid-19 protocols for community meal programmes. He is currently a Trustee of Christ Church Cathedral, Vancouver and is a past Board Member of the 127 Society for Housing, a charity providing housing primarily to low-income seniors. Kevin is a graduate of Princeton University (B.A., History) and Oxford University (B.A., Jurisprudence). He and his family love spending time outdoors, and he recently accomplished a bucket-list goal by completing the Boston Marathon.
