Matthew L. Tuccillo is a nationally recognized securities litigator who oversees complex class action litigation across the U.S. and regularly counsels institutional investor clients from the U.S. and abroad. 


Matt is lead counsel, with his foreign pension fund client serving as court-appointed lead plaintiff, in In re Emergent Biosolutions, Inc. Securities Litigation, a securities class action lawsuit arising from a company’s COVID-19 vaccine manufacturing failures. In September 2023, Matt secured partial denial of the motion to dismiss and is leading the case through discovery. 


Matt is lead counsel for the Exchange Act §10(b) class, with his foreign pension fund client as lead plaintiff, in Edwards v. McDermott Int’l, Inc., a securities class action lawsuit where he overcame a motion to dismiss claims alleging fraud by a company that did a risky merger, delayed massive write-downs, and declared bankruptcy. Matt is leading the case through discovery and secured court orders requiring defendants to review for production 1.25 million+ documents identified via plaintiff-authored search terms on plaintiff-selected custodians. 


Matt was co-lead counsel in Chun v. Fluor Corp., with two of his U.S. pension fund clients as co-lead plaintiffs, and steered the securities class action lawsuit arising from underperforming, large-scale, fixed-bid projects through two motions to a $33 million settlement approved by the court in 2022. 


Matt has served as lead litigator overseeing numerous other securities class actions, including Kendall v. Odonate Therapeutics, Inc. ($12.75 million settlement), In re Toronto-Dominion Bank Securities Litigation ($13.25 million settlement), Perez v. Higher One Holdings, Inc. ($7.5 million settlement), In re KaloBios Pharmaceuticals, Inc. Securities Litigation ($3.25 million settlement), and In re Silvercorp Metals, Inc. Securities Litigation ($14 million settlement). 


As lead Pomerantz litigator in In re BP p.l.c. Securities Litigation, Matt pursued opt out lawsuits by institutional investors arising from BP’s 2010 Gulf of Mexico oil spill, where he overcame three motions to dismiss, established significant cutting-edge precedent, and pursued discovery over 9 years. Matt secured confidential, favorable monetary settlements for all 35 Pomerantz clients, including public and private pension funds, money management firms, partnerships, and trusts from the U.S., Canada, the U.K., France, the Netherlands, and Australia. 


Matt regularly counsels foreign and domestic institutional investors regarding pending or potential U.S. lawsuits. When litigation is filed, he fully oversees its conduct and resolution, counseling clients at every step. Matt’s skills have attracted many institutional clients to sign with him for litigation and/or portfolio monitoring services, and they are regularly appointed to lead important securities fraud class actions across the U.S.
