Shankh Sengupta is the Head of the Dispute Practice and specialises in commercial disputes and white-collar crimes. He regularly represents Indian and multinational clients in corporate and commercial disputes before various courts and tribunals in India. Shankh represents shareholders in disputes before the Company Law Board/National Company Law Tribunal, High Courts and the Supreme Court of India. A substantial part of his practice is conducting institutional and ad-hoc arbitrations in disputes arising from construction contracts, hotel management and other commercial contracts in India and abroad. Shankh has acted for several clients on the enforcement of foreign arbitral awards from foreign courts. He represents clients before investigative authorities such as CBI, ED and SFIO. He advises conglomerates on contentious mergers, demergers and amalgamations. Shankh has been acting for commercial banks, funds, construction majors, telecom and broadcasting giants and manufacturing companies on criminal and quasi-criminal matters and in actions against the government. He has represented defense equipment suppliers in matters involving public procurement and mismanagement of investor funds.

  • Advised and represented cdc India Opportunities Limited before the National Company Law Tribunal, Principal Bench (NCLT) in an ongoing oppression and mismanagement dispute (O&M Dispute).

  • Advised NCR Corporation India Private Limited (the Company) in its strategy and representation before the High Court against the motivated FIR. This resulted in the Company successfully obtaining interim protection for its managing director and other senior and mid-level employees during the pendency of the investigation by the police.
  • Advised to Chinese Banks on negotiations for restructuring, enforcement of security held, litigation strategy to be adopted before the NCLT-Mumbai, NCLAT, Delhi High Court and Supreme Court, settlement and assessment of the Chinese Banks’ rights in a dispute arising between various lenders of the RCom Group. Represented the Chinese Banks before the NCLT-Mumbai, the NCLAT-New Delhi and the Supreme Court in inter-se disputes between the lenders of the RCom Group.
  • Represents Public Sector Pension Investment Board in the suit filed before the Delhi High Court by Bid Services Division (Mauritius) and was advising it in its discussions with GVK and the other investors.
  • Represents Uttar Pradesh Power Corporation to oppose a Change in Law claim raised by RKM Powergen Private Limited (RKM) before the Uttar Pradesh Electricity Regulatory Commission.
  • Represents IndiaRF, who was the largest financial creditor, before the NCLT, Mumbai in the proceedings against Indian Steel and before the DRT in the proceedings against the Promoter in respect of personal guarantee issued by Kailash Shahra.
  • Represents KKR Consortium as well as their Security Trustee and Debenture Trustee, comprising of 5 lenders on the various legal, commercial, and strategic issues with regard to the restructuring of the business of the Company as well as the sale of its subsidiaries.
