Virginia Carron practices patent and trademark litigation and counseling. Her broad client base includes a large food and beverage company; a company involved in refining, chemicals and biofuels, forest and consumer products, fertilizers, polymers and fibers, pollution control and glass; an international manufacturer of hand-made cigars; and numerous international clients in various fields. Virginia has been recognized as one of WIPR’s Top 100 Most Influential Women in IP, an IP Star Top 250 Women in IP and a patent and trademark IP Star in Georgia by Managing Intellectual Property, as well as a leader in Georgia in private practice by Intellectual Asset Management 1000 and as an IAM Global Leader.

Virginia’s litigation experience includes numerous U.S. district court trials, trials before the U.S. International Trade Commission - and appeals to the U.S. Court of Appeals for the Federal Circuit. Virginia counsels clients on intellectual property licensing and related transactional matters in both patents and trademarks for several Fortune 500 companies, including serving as the primary outside counsel to Imerys and its worldwide subsidiaries for all intellectual property matters. Her practice also includes inter partes review procedures before the Patent Trial and Appeal Board (PTAB) of the U.S. Patent and Trademark Office -.

Virginia has served as first chair in several litigations representing the Fuente Cigar companies in cases involving trademark, trade dress, unfair competition, and false advertising issues, as well as serving first chair for several different plaintiffs in counterfeiting and trademark infringement litigation which resulted in the recovery and destruction of millions of dollars worth of counterfeit goods, and in two cases, (C.D. Cal. and D.N.H.) ultimately resulted in the incarceration of counterfeiters of computer memory products.

On a pro bono basis, Virginia has represented numerous disabled military veterans challenging disability compensation decisions in appeals to the U.S. Court of Appeals for Veterans Claims. She was recognized by the Federal Circuit Bar Association and its Charitable and Education Fund for pro bono service contributions, particularly for work on behalf of veterans. Virginia previously served on the firm’s management committee and as managing partner of the firm’s Atlanta office.

Representative Experience:

  • Co-lead representing Nestle in patent litigation involving patents directed to methods for producing lightweight plastic containers.
  • On behalf of Nestle, served as co-lead and obtained a favorable construction leading to a stipulated judgment of non-infringement in long-running litigation over antiseptic packaging.
  • As first chair, representing defendant Molex, Inc. in patent litigation involving six patents for electric connectors.
  • As first chair, represented Fuente on appeal of an adverse TTAB decision related to a cigar trademark in front of the U.S. Court of Appeals for the Federal Circuit.
