In one case sample, the firm represented Nestlé in a consolidated suit against MadLabs, their former service provider for a marketing campaign involving a QR code. Nestlé sought a declaration that the QR code provided by MadLabs for their Maggi Hot Cup noodle product held no intellectual property rights. After Nestlé mistakenly printed the QR code on their Hot Cup noodle products, issues arose when the redirection of the QR code went awry, leading users to offensive sites. Nestlé also claimed negligence, unlawful interference with trade and defamation against MadLabs due to the redirection. The case is significant as the High Court ruled for the first time in Malaysia that a dynamic QR code comprised solely of pixels lacks intellectual property rights, including copyright. MadLabs failed to prove the use of proprietary software in developing the QR code. Despite having control over the QR code, MadLabs cannot charge Nestlé royalties or costs per print.

Recent clients include Guangzhou Trinity Cycles, Lego, NGC Energy, Suzhou Dake Machinery and Tanjung Offshore Services.

Effective December 1, 2022, the IP practice of Zaid Ibrahim & Co has been carved out from ZICO Law as an independent IP law firm. This change aims to streamline and consolidate its Asean regional IP practice, allowing for better conflict management. The ZICO IP regional network will continue to operate under the management of the new IP firm in Malaysia, known as ‘LindaWang Su & Boo (a member of ZICO IP)’.
