Justin D. D’Aloia is a Partner in Pomerantz’s New York office, where he specializes in securities class action litigation. He has extensive experience litigating high-profile securities cases in federal and state courts across the country involving a range of industries, including financial services, life sciences, real estate, telecommunications, technology, and consumer retail. His practice covers the full spectrum of proceedings from pre-suit demand through settlement.
Justin leads the firm’s cases against the telecommunications companies Lumen and AT&T. Pomerantz is Lead Counsel in both cases. In July 2023, a Wall Street Journal investigation revealed that many telephone cables owned by these companies are wrapped in toxic lead and were abandoned across the United States as the companies transitioned to fiber optic technology. Some of these cables are buried underground, where the lead can leach into the soil, and others hang aerially in areas frequented by families and children, including schools and playgrounds. Following the publication of the Wall Street Journal article, stock prices for major telecom companies plummeted. The lawsuits allege that the companies had known for years about the dangers posed by the lead in these cables, but made misleading statements to investors about their environmental initiatives and the benefits of transitioning to fiber without disclosing these facts. Using securities litigation as a tool to address ESG issues, Justin is sending a clear message to corporations that their impact on the environment matters to shareholders, who will hold corporations accountable.
Beyond his notable legal work, Justin is committed to giving back to the community and mentoring the next generation of lawyers. He has mentored first-year law students at his alma mater, Fordham Law School, where he has shared his experiences and provided guidance to aspiring attorneys. Additionally, Justin has undertaken significant pro bono work, including helping to file a report for the Innocence Project on behalf of Michael Morton, who was wrongly convicted of murder. He also advocated for New York City to make voter information packets available in different languages, ensuring more New Yorkers have access to important information about their civic rights.
Justin received his J.D. from Fordham University School of Law, where he was Editor-in-Chief of the Fordham International Law Journal. He earned his undergraduate degree from Rutgers University with a concentration in Business and Economics and served as a law clerk to Judge Mark Falk of the United States District Court for the District of New Jersey.
