Shalaka is a Partner in the dispute resolution practice of Trilegal and focuses on commercial litigation, international and domestic arbitration as well as company law matters. She has wide-ranging experience and has acted for clients in several complex, commercial disputes including shareholder disputes, IP and media disputes, construction and infrastructure cases, investor-promoter disputes, employment disputes and writ actions against state authorities. She has advised on bilateral investment treaties as well.
 
She has acted in a wide range of cases before the Supreme Court, Bombay High Court as well as other High Courts including Delhi, Madras, Calcutta, Gujarat, Goa and Uttarakhand and various other courts and tribunals. She has also acted in international and domestic arbitrations including those seated in Singapore, London, Zurich and New York.
 
In addition to civil litigation, Shalaka also acts in a number of white-collar criminal disputes for multinational companies and represents them in various courts in India.
 
She also acts and advises on insolvency litigation.
 
Some of her key clients include an international airline for whom she handles all their India related disputes matters, a leading insurance company for whom she handles several white collar, IP and regulatory disputes, various infrastructure companies in their infrastructure and construction arbitrations as well as pre-dispute strategic work.

  • Successfully obtained ad-interim status quo for a Singapore based commercial real estate investment firm in a suit for specific performance of an MoU entered into for the purchase of land parcels and construction of warehouses on the same by the Client. Upon vacation of the said order of ad-interim status quo by the Trial Court, Trilegal successfully represented the Client in obtaining a stay on the order vacating ad-interim status quo from the Hon’ble Bombay High Court. Owing to the same, the counter-parties agreed to settle the dispute and perform their obligations under the MoU.
  • Successfully obtained ad-interim status quo for a leading architectural design firm and construction company in arbitration proceedings challenging the termination of agreements for design and construction of a residential premises. Trilegal also successfully defended writ and appeal actions before the High Court against the order of status quo, which were dismissed on maintainability.
  • Successfully represented a global investment firm in enforcing a SIAC award of INR 661 crores before the Hon’ble Madras High Court. Trilegal successfully obtained orders from the Court to prevent asset dissipation and for full disclosures of assets from the promoters. Additionally, an Additional Advocate Commissioner was appointed to liquidate assets, including fixed deposits, shares, and bank accounts. The promoters were also directed to provide an undertaking for the sale proceeds to be invested in a fixed deposit in favour of the the Registrar General.
  • Successfully represented a global leader in customer experience technology in a writ petition under Article 226 of the Constitution of India, challenging ex-parte Demand Notices, Recovery Notices, Prohibitory Orders, and Show Cause Notices issued by the Employees' State Insurance Corporation (ESIC). Trilegal successfully obtained Orders from the Hon’ble Bombay High Court directing ESIC officers not to encash the Demand Draft and to refrain from further coercive actions, providing the client with necessary reprieve until the matter was heard.
