  • The real estate project cooperation and loan dispute between Sichuan Yajule Real Estate Development Co., Ltd. (hereinafter referred to as "Yajule Company") and Chengdu Xueling Enterprise Management Co., Ltd. (hereinafter referred to as "Xueling Company"), a subsidiary of Guangzhou Xuesong Group, near the Chengdu high-speed railway station has had a huge impact in Chengdu. his case involves a principal of 1113880000 yuan, interest and liquidated damages of 589982150.76 yuan, and the final subject matter of the case exceeds 2 billion yuan. At the time of the incident, there was a huge dispute over the jurisdiction of this case due to factors such as the financial explosion of Guangzhou Xuesong Group and the complexity of the case. Chengdu and Guangdong were competing for jurisdiction, and there were multiple obstacles when applying for property preservation, involving complex situations such as intertwined litigation in multiple places and cases. Our lawyer efficiently promoted the case, successfully filed and preserved it, and ultimately determined that it would be under the jurisdiction of the Chengdu Intermediate People's Court where the real estate project is located. In June 2024, the represented Yajule Company won the first instance judgment, and in August 2024, it won the second instance judgment of the Sichuan Provincial High People's Court. This case successfully avoided the project from being involved in bankruptcy proceedings in the later stage despite the financial crisis of Cedar Group, laying a solid foundation for the smooth operation of the project in the later stage. It also laid a solid foundation for the project to complete the delivery guarantee task and avoid significant social impact, winning the trust and praise of customers and local governments.
  • Yongqing Jiantou Junyuan Real Estate Development Co., Ltd. (hereinafter referred to as Junyuan Company) is a project company located in Yongqing County, established by Hebei Jiantou Lujin Urbanization Construction and Development Co., Ltd. (hereinafter referred to as Hebei Jiantou Company) and Langfang Tianyuan Mountain Resort Ecotourism Co., Ltd. (hereinafter referred to as Langfang Tianyuan Ecotourism Company). Junyuan Company has signed the "Rural Land Contract Management Right Transfer Contract" with numerous land rights holders in Yongqing County to transfer land and pay nearly 80 million yuan in transfer fees. The transferred land located in Yongqing County involved in the case was included in the overall planning scope of the Beijing Daxing Airport Economic Zone. The land was requisitioned and expropriated by the government, and Junyuan Company could no longer use the transferred land involved in the case. Therefore, Junyuan Company sued the land rights holder to return the transfer fees according to the contract agreement. Junyuan Company will file the above-mentioned case in three batches to Yongqing County People's Court, The first batch of 14 cases were first tried in court. As Junyuan Company is not the rightful owner of the land and does not have relevant evidence about land expropriation and requisition, the defendant Fu Lijun of the 14 cases did not confirm whether the land was expropriated or not. Moreover, Fu Lijun disagreed with Junyuan Company's lawsuit request on the grounds that he is the actual controller of Langfang Tianyuan Ecological Company and the above-mentioned land transfer behavior is an official act. Therefore, lawyer Wang Xuegang applied to the court for investigation and evidence collection, but Yongqing Court did not retrieve it and directly rejected Junyuan Company's lawsuit request. Junyuan Company filed an appeal, and lawyer Wang Xuegang continued to apply for investigation and evidence collection during the second instance. Although the Langfang Intermediate People's Court issued an investigation order, the investigated units, including the Langfang Municipal People's Government, Yongqing County People's Government, Yongqing County Natural Resources and Planning Bureau, did not provide relevant materials. The Langfang Intermediate People's Court directly rejected Junyuan Company's appeal request. Lawyer Wang Xuegang insisted on recommending Junyuan Company to apply for retrial and continuously reported and complained about the above situation to relevant departments. From the first instance filing in June 2021 to January 2024, the Higher People's Court of Hebei Province issued a ruling designating the Langfang Intermediate People's Court of Hebei Province to re try 14 cases. After 2 and a half years, Lawyer Wang Xuegang went to Yongqing County multiple times to understand the situation of the case and applied to relevant government agencies to obtain relevant evidence on land expropriation and requisition. Through Lawyer Wang's continuous efforts, this batch of cases finally saw a turning point in the retrial process. The construction of Beijing Daxing Airport's airport economy has led to the suspension of all approval work, including land transfer, agricultural land conversion, land use, and project approval, which have been included in the overall planning of the airport economic zone. As a result, a large number of similar disputes have arisen. The Hebei Higher People's Court has designated Langfang Intermediate People's Court to conduct a retrial of this batch of cases, which has guiding significance for possible large-scale land cases in the future. This batch of litigation has also helped Junyuan Company recover losses of more than 80 million yuan. In addition, the final investor of Junyuan Company is the State owned Assets Supervision and Administration Commission of Hebei Province. The success of the retrial of this batch of cases has also prevented the loss of state-owned assets.
  • Representing Evergrande Bank Co., Ltd. in cross-border recovery investigations targeting the concealed assets of Lu Shengju (actual controller of Chongqing Caixin Group) and his spouse in the United States, as well as the cross-border recognition and enforcement of Chinese court judgments. The case involves a disputed amount of several billion RMB. Preliminary investigations require tracing properties hidden and transferred by the subjects, which is both time-consuming and challenging. Additionally, the case demands cross-jurisdictional coordination between China and the United States to recognize and enforce Chinese judgments in the US. Given the two countries' distinct legal systems (China being a civil law jurisdiction and the US a common law jurisdiction), this process requires highly specialized expertise.
